Find an Immigration Lawyer

Get help with your H-1B petition from an experienced attorney

While you do not need a lawyer for the H-1B registration lottery itself (your employer handles that), an experienced immigration attorney can be invaluable for preparing a strong H-1B petition after selection.

When you need an immigration lawyer

After lottery selection

To prepare and file Form I-129 (H-1B petition) with the strongest possible case.

Complex cases

If your degree does not directly match your job title, you need a credential evaluation, or you have prior immigration issues.

RFE response

If USCIS issues a Request for Evidence (RFE), an attorney can craft a targeted response.

Employer issues

If your employer is not familiar with the H-1B process or has not sponsored workers before.

Change of status

If you are already in the US on a different visa and need to transition to H-1B status.

How to find a lawyer

AILA Lawyer Search: The American Immigration Lawyers Association maintains a directory of immigration attorneys. Visit aila.org/find-an-attorney to search by location and specialty.

Key questions to ask:

  • How many H-1B petitions have you filed?
  • What is your approval rate?
  • How do you handle RFEs?
  • What are your fees? (typical range: $2,000-$5,000 for H-1B)
  • Will the attorney personally handle my case or delegate to staff?

Red flags: Guarantees of approval (no lawyer can guarantee this), pressure to pay upfront without a written agreement, or difficulty reaching the attorney.

We are building a curated directory of vetted immigration attorneys.
